FOR NON MANDATORY APPEARANCES FOR ORDINANCE AND TRAFFIC CITATIONS IN NEW HOLSTEIN MUNICIPAL COURT

The New Holstein Municipal Court has jurisdiction over traffic and non-traffic ordinance violations in the city of New Holstein.
Court Times: Wednesday 1:00PM for juvenile non-traffic violations.  1:30PM for all adult ordinance violations and all traffic violations.

I just want to pay my fine: What should I do?

You do not have to appear in court if you send the deposit amount as shown on your citation  prior to your court date or the deposit may be paid in person at the New Holstein Police Department.

Include your citation and the court date with a money order to assure proper handling.  Cash is accepted if you pay in person.
 



I wish to plead NOT GUILTY by mail: How do I do this?

If you wish to plead NOT GUILTY, you do this by mail without appearing in court on the date written on your citation. Write a letter saying that you plead NOT GUILTY. You must include the Offense, the date you were scheduled to appear, the ticket number, your current mailing address and your phone number. This letter, called a "plea", must be received prior to the court date on the citation. Mail the plea to:

Upon receipt of your Plea, you will be scheduled for a Pre-Trial Conference at the Police Department on a subsequent first Wednesday of a Month.  You will be sent a letter of the exact date and time of your pre-trial.

If you are not satisfied with the results of the Pre-Trial you can  request a trial at New Holstein Municipal Court.  You will again receive a letter notifying you of the date and time.

If you send a deposit after you have entered a not guilty plea, you will be removed from the trial calendar and found guilty. 

If you fail to appear in court, a warrant may be issued for your arrest or a default judgment may be entered against you for the amount of the citation. If you fail to pay the judgment imposed, your driving privileges could be suspended for up to two years. 



What will happen when I appear in court on the date on my citation?

The date on your citation is the date of your initial appearance. An initial appearance is your opportunity to enter a plea to the charge. You may plead GUILTY, NO CONTEST, or NOT GUILTY. The initial appearance is not the trial date. If you plead guilty, you are admitting that you committed the offense, and if the arrest report contains the necessary elements, you will be found guilty and a penalty will be imposed.  If you plead no contest, you are neither pleading guilty nor not guilty, but merely want to have the matter resolved and pay the penalty.  The effect of this plea is that the court will find you guilty and the matter will be resolved at the initial appearance.  You however, will not be admitting your civil liability for the use in other litigation, which should be expected where personal injury or property damage is involved.  If you plead not guilty, your case will be scheduled for a Pre-Trial Conference.

PLEASE NOTE: If you do not appear or enter a plea before your return date, a warrant may be issued for your arrest or a default judgment may be entered against you for the amount of the citation. If you fail to pay the judgment imposed, your driving privileges could be suspended for up to two years. You shall assume additional costs for reinstatement of your license. It is YOUR RESPONSIBILITY to contact the court BEFORE the return date listed on your citation. I'm worried about the points to be assessed against my driving record: How do I know if I'm in point troubles?

If you are found guilty of a traffic violation, your driving record may be charged with demerit points. The court will not determine the number of points assessed against your record. The court will merely report the conviction to the Wisconsin Division of Motor Vehicles and the DMV will add the number of points against your record, depending upon the charge. 

If you accumulate 12 points against your driving record within a one year period by date of violations, your license will be suspended or revoked. 

If you have a probationary license, second and subsequent violations will result in double demerit points being assessed.
